Self-Drive Car Service

Welcome to BTAride Self-Drive Car Service. Please read these Terms
and Conditions carefully before using our website (the "www.btaride.com")
and the services, features, content, or applications offered by BTAride. By
accessing or using the Service, you agree to be bound by these Terms. If you do
not agree to all the terms and conditions of this agreement, then you may not
access the Service.
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by
these Terms and all applicable laws and regulations. If you do not agree with
any of these Terms, you are prohibited from using or accessing this site.
2. Use License
1. Permission is granted to temporarily download
one copy of the materials (information or software) on BTAride's website for
personal, non-commercial transitory viewing only. This is the grant of a
license, not a transfer of title.
2. Under this license, you may not modify or copy
the materials and use the materials for any commercial purpose or for any
public display (commercial or non-commercial) and/or attempt to decompile or
reverse engineer any software contained on BTAride's website and/or remove any
copyright or other proprietary notations from the materials and/or transfer the
materials to another person or "mirror" the materials on any other
server.
3. Disclaimer
The materials on BTAride's website are provided on an 'as is'
basis. BTAride makes no warranties, expressed or implied, and hereby disclaims
and negates all other warranties including, without limitation, implied
warranties or conditions of merchantability, fitness for a particular purpose,
or non-infringement of intellectual property or other violation of rights.
4. Limitations
In no event shall BTAride or its suppliers be liable for any
damages (including, without limitation, damages for loss of data or profit, or
due to business interruption) arising out of the use or inability to use the materials
on BTAride's website, even if BTAride or a BTAride authorized representative
has been notified orally or in writing of the possibility of such damage.
5. Governing Law
These Terms shall be governed and construed in accordance with
the laws of Jurisdiction, without regard to its conflict of law provisions.
6. Changes to Terms
BTAride reserves the right, at its sole discretion, to modify or
replace these Terms at any time. If a revision is material, we will try to
provide at least 30 days' notice prior to any new terms taking effect.
By continuing to access or use our Service after those revisions
become effective, you agree to be bound by the revised terms. If you do not
agree to the new terms, please stop using the Service.
By accessing the Service, you signify your acceptance of these
Terms. If you do not agree to these Terms, please do not use our Service. Your
continued use of the Service following the posting of changes to these Terms
will be deemed your acceptance of those changes.
7. User Responsibilities
By using our Service, you agree to:

Provide accurate and
current information when registering for our Service.

Keep your account
credentials confidential and notify us immediately if you suspect unauthorized
access to your account.

Comply with all
applicable laws, rules, and regulations while using our vehicles, including but
not limited to traffic laws and safety regulations.
8. Vehicle Usage

Only authorized
drivers listed on the rental agreement are allowed to drive the rented vehicle.
·
Use the vehicle for
legal purposes and not engage in any illegal activities while operating the
vehicle.
·
Not use the vehicle
under the influence of alcohol, drugs, or any other substances that may impair
driving abilities.
·
Not sublet, lend, or
otherwise provide the vehicle to any third party.
9. Rental Fees and Payments
·
Agree to pay all fees
and charges associated with the rental, including but not limited to rental
fees, fuel charges, toll fees, and any additional services requested.
·
Provide a valid credit
card for payment, and authorize BTAride to charge the card for all fees and
charges.
10. Insurance and Damages
·
Understand and
acknowledge the insurance coverage provided for the rental vehicle. Any
additional coverage must be arranged and paid for by the renter.
·
Agree to report any
accidents, damages, or malfunctions to BTAride immediately and follow the
provided instructions for reporting incidents.
11. Reservation Changes and Cancellations
·
Understand the cancellation
policy, including any fees associated with cancellations made within a
specified time frame.
·
Notify BTAride in
advance for any changes to the reservation, subject to availability and
applicable fees.
12. Termination
BTAride reserves the right to terminate or suspend your account
and access to the Service at our sole discretion, without prior notice, for any
violation of these Terms or for other conduct that we believe is harmful to
other users of the Service or to us.
13. Limitation of Liability
BTAride shall not be liable for any indirect, incidental,
special, consequential, or punitive damages, or any loss of profits or
revenues, whether incurred directly or indirectly, or any loss of data, use,
goodwill, or other intangible losses resulting from:

Your use or inability
to use the Service.
·
Any unauthorized
access to or use of our servers and/or any personal information stored therein.
·
Any interruption or
cessation of transmission to or from the Service.
·
Any bugs, viruses,
trojan horses, or the like, which may be transmitted to or through the Service
by any third party.
14. Entire Agreement
These Terms constitute the entire agreement between you and
BTAride concerning the Service and supersede and replace any prior agreements,
oral or written, between you and BTAride regarding the Service.
15. Vehicle Inspection and Return

Agree to inspect the
vehicle thoroughly before taking possession and report any pre-existing damages
to BTAride to avoid liability.
·
Return the vehicle in
the same condition it was rented.
·
Agree that any
additional cleaning required beyond a reasonable level will result in a
cleaning fee.
16. Late Returns and Extensions
·
Understand that late
returns may result in additional charges. If you need to extend the rental
period, contact BTAride in advance to arrange for an extension. Extensions are
subject to vehicle availability.
17. GPS Tracking and Data Collection
·
Acknowledge that the
vehicle may be equipped with GPS tracking devices for safety, security, and
operational purposes.
·
Consent to the
collection and use of location data during the rental period.
18. Age and Licensing Requirements
·
Agree that drivers
must meet the minimum age requirement and hold a valid driver's license.
19. Prohibited Uses
·
Agree not to use the
vehicle for any prohibited purposes, including but not limited to towing,
racing, off-road driving, transporting illegal substances, or engaging in any
criminal activity.
·
Agree not to use the
vehicle in violation of export control or sanctions laws of the Government of
India or your local jurisdiction.
20. Communication
·
Agree to receive
communications from BTAride regarding your reservation, rental, and promotional
offers via email, phone, or SMS. You can opt-out of promotional communications
at any time.
21. Governing Law and Dispute Resolution
·
These Terms and any
dispute arising out of your use of the Service will be governed by and
construed in accordance with the laws of Jurisdiction. Any legal action or
proceeding relating to your access to or use of the Service shall be resolved
through arbitration.
22. Severability
·
If any provision of
these Terms is deemed invalid or unenforceable, that provision will be deemed
severable from these Terms and will not affect the validity and enforceability
of the remaining provisions.
23. Maintenance and Repairs
·
Understand that
routine maintenance is the responsibility of BTAride. However, if the vehicle
requires repairs due to negligence or misuse, the cost of repairs will be borne
by the renter.
·
Agree to promptly
report any mechanical issues or breakdowns to BTAride and follow the provided
instructions.
24. Indemnity
·
Agree to indemnify and
hold BTAride, its affiliates, officers, agents, employees, and partners
harmless from and against any claims, liabilities, damages, losses, and
expenses, including without limitation, reasonable attorney's fees and costs,
arising out of or in any way connected with your use of the Service.
25. Force Majeure
·
Understand that BTAride
shall not be liable for any failure or delay in performing its obligations
under these Terms if such failure or delay is due to circumstances beyond its
reasonable control, including but not limited to acts of God, war, terrorism,
labor disputes, equipment failure, or governmental restrictions.
26. User Reviews and Feedback
·
Agree that BTAride may
use customer reviews and feedback provided by users for marketing and
promotional purposes on the website or other marketing materials, without any
further approval.
27. Amendments
·
BTAride reserves the
right, at its sole discretion, to modify or replace any part of these Terms. It
is your responsibility to check these Terms periodically for changes. Your
continued use of or access to the Service following the posting of any changes
to these Terms constitutes acceptance of those changes.
28. Third-Party Services
·
BTAride may use
third-party services or products to enhance the functionality of the Service.
Your use of these third-party services may be subject to separate terms and
conditions imposed by the providers of those services.
29. No Waiver
·
The failure of BTAride
to enforce any right or provision of these Terms will not be deemed a waiver of
such right or provision.
30. Headings
·
The section headings
in these Terms are for convenience only and have no legal or contractual
effect.
31. Entire Agreement
·
These Terms constitute
the entire agreement between you and BTAride regarding the use of the Service,
superseding any prior agreements between you and BTAride regarding the Service.
